Can my ex sue me for charges made on his credit card to pay my debts?
I lived with my ex for 2 years, much of which time he did not have a job and I covered living expenses. He paid some of my personal debt off with his credit card. I made several cash payments to him, for which I have no record for. Also, one of the items was a gift from him. He states his father, a retired military officer and his credit card co-signer, will testify on his behalf that we had an oral contract and I did not pay the money. He states I owe him over $2000! Also, yesterday i had to pay $175 in overdraft fees on our joint account that I hadn’t touched since April and he had $200 from his utility bill transferred to my new account. I do not owe this money and cannot afford a lawyer. He states he will file a suit against me next week and garnish my wages. I reside in Virginia. Am I going to be held liable?
You wrote, “I … cannot afford a lawyer.”
Well, look in your phone book for something called the “Legal Aid Society,” which provides low-cost, or even free, legal help for folks just like you!
Of course, it may be called something else where you live, so if you don’t find a listing for “Legal Aid Society” in the phone book, you could do a google.com search for “free legal aid” plus the name of the city/state you live in.
Good luck!
